Online Coaching Agreement REQUIREMENTS OF SERVICE PROVIDER * Julie Salter Fitness, LLC will design a tailored nutrition and/or exercise program for the Client that reflects the client’s objectives, fitness level, and experience. The program may include one or more of the following: • Custom program oriented towards Client’s goal(s) • Custom macros or other standard nutrition protocol based on Coach and Client discussion (this may vary from client to client when taking personal needs into account • Nutritional and exercise tips and support • Private messaging availability • Check-ins with responses from Coach • 24-48 hr response time to all messages in the Training App • Access to 1:1 client FB group for exclusive content • Access to additional resources & E-books • Plan delivery within 7 business days of payment, initial photos and personal client document submission. I agree Julie Salter Fitness, LLC EXPECTATIONS OF CLIENTS: • Coach and Client will have check-ins to ensure Client is progressing through the coaching program. • Coach will be available for messaging support and questions throughout the week. Clients will receive a response from their coach within 24-48 hours of the client’s last message sent on business days. • Client understands their results are a direct reflection of their effort, health history and lifestyle. • Clients will execute plans to the best of their ability each week. • Check ins are due before NOON Pacific time on designated check in day, which is subject to change if need be. • Coach will respond to on time check-ins within 24-48 hours of submission. Late check-in submissions will not be honored. • Any exercise or nutrition protocol adjustments, or exercise form assessments, should be addressed during check-ins. • Julie Salter Fitness, LLC will observe all national holidays. • If Julie Salter Fitness, LLC can not meet the communication expectations it will be clearly communicated. • Clients will follow the guidelines for “how to check in with coach” once plan has been delivered in detail. Initial below * BILLING The client must opt in to automatic recurring billing or pay for the duration of their contract in full. Once original agreement has been completed, client will automatically move into a month-to-month payment plan. If client received a discount on their original coaching package, month-to-month billing will resume at full coaching cost unless client opts to sign a new agreement, which will honor their original discounted pricing. Once original agreement has been completed and client wishes to end coaching, a 30 day notice must be submitted in writing to SUPPORT@JULIESALTERFITNESS.COM Company shall supply the client an electronic receipt for all amounts paid under this agreement. The client must pay before the start of services. Clients are allowed to pay multiple months upfront in advance if desired. Clients are allowed a maximum of 2 weeks to delay their billing for 1 time only if circumstances occur. During this time all services will be paused. Initial below * CANCELLATIONS & DISMISSALS Julie Salter Fitness, LLC holds the right for all sales to be final & non-refundable. If this Agreement is terminated by Client, Client shall pay a termination fee equal to 50% of the uncharged balance of their total package cost. Payment is due on the day of cancellation. Client is not entitled to a refund for cancellation if they paid in full for services. This break contract policy applies to any re-signs and extensions agreed upon between coach and client. If the client fails to engage in communication and establish payment arrangements with Julie Salter Fitness, LLC for a consecutive period of 14 days or longer, the company retains the authority to transfer the debt to a collection agency for necessary actions, without providing any additional notice to the client. In such event, all coaching and access to the program will cease and the client shall be responsible for the full remaining contract balance and the 50% cancellation fee above shall not apply to cover cost of engaging the debt collection agency. Initial below * COMMERCIAL USE OF INFORMATION All before and after photos as well as statements received by Julie Salter Fitness, LLC is of fair use if granted permission for promotion and commercial use unless further notified by the client in which case all material will be taken down. Initial below * DISCLAIMER Julie Salter Fitness, LLC provides services geared towards health & fitness and any unfortunate element with any health and fitness journey is the risk of harm to the individual. Julie Salter Fitness, LLC requires all future clients to be cleared by a health professional before beginning any of the services provided. The client should stop any activity that may cause harm upon themselves while under our services. Julie Salter Fitness, LLC will not be liable for any and all actions/fees that may occur on behalf of the client while using our services and afterwards. The client waives all rights for prosecution against Julie Salter Fitness, LLC by agreeing to these terms. Results are never guaranteed even though you are set up with the best tools and resources possible to achieve the results you desire. By participating in the online coaching program, Client understands and agrees that Julie Salter Fitness, LLC is not a medical practitioner nor a registered dietician. Any nutritional guidance or information given is not meant to be used as prescriptions for diets, or supplements to treat any medical or clinical condition, to treat any symptoms of a medical or clinical condition or to diagnose a medical or clinical condition. Any nutritional information given is merely information regarding nutrition for healthy individuals only. Initial below * ONBOARDING Clients will sign and agree to the contract of policies and procedures. Clients will submit payment upon execution of this contract. All plans will be delivered within 7 business days of payment on business days. Initial below * CHECK INS & UPDATES Clients are encouraged to ask questions and communicate with Julie Salter Fitness, LLC throughout the week. Clients must complete any assigned tasks prior to checking in. Clients will execute plans to the best of their ability each week. Check ins will be submitted using the mobile app and clear instructions provided. Plan updates will be provided within 48 hours of check in submission. Client check ins will occur per the provided schedule. Check ins must be completed on time. Late or skipped check ins will not be accepted. Initial below * COMMUNICATION Julie Salter Fitness, LLC will respond to all forms of communication within 48 hours or less on business days. Clients are expected to respond to all communication including check in feedback within a 48 hour period. If Julie Salter Fitness, LLC will be undergoing foreseen circumstances to where they can not meet the communication guidelines it must be communicated. If a client will be undergoing foreseen circumstances to where they can not meet the communication guidelines it must be communicated . Client dissatisfaction must be communicated by email immediately. Cease of services will occur by email/written communication between Julie Salter Fitness, LLC and the client. Initial below * Billing issues will only be discussed by email support@juliesalterfitness.com Billing issues need to be discussed a minimum of one week prior to the next billing cycle or client will be charged. If a response is not received by the client within the allotted time then all actions will proceed or will be paused as necessary at the discretion of Julie Salter Fitness, LLC. Coach and Client mutually agree to refrain from making any disparaging statements, either orally or in writing, about each other, or any affiliate of the Coach or Company.
